General Terms and Conditions
SwissCookware by Zöllner

1. Scope and General Provisions
These General Terms and Conditions (GTC) of SwissCookware by Zöllner, St. Leonhard-Strasse 45, 9000 St. Gallen, apply to all business relationships of SwissCookware by Zöllner with its customers.
SwissCookware by Zöllner offers its customers high-quality kitchen utensils and kitchen accessories for purchase. It owns and operates the website www.kuechenglueck.ch for this purpose.
A customer is any natural and legal person who maintains business relationships with SwissCookware by Zöllner.
These GTC apply exclusively. Contradictory, supplementary or deviating conditions require the express written confirmation by SwissCookware by Zöllner to be effective.
The customer confirms, when purchasing items from SwissCookware by Zöllner and when using www.kuechenglueck.ch or upon conclusion of a contract, to comprehensively acknowledge these GTC.
For reasons of better readability, the masculine form is used in these GTC for personal designations and particular nouns. Corresponding terms generally apply to all genders in the sense of equal treatment. The shortened form of language is for editorial reasons only and does not imply any valuation.
2. Information from SwissCookware by Zöllner
Brochures and advertising material from SwissCookware by Zöllner, as well as the website www.kuechenglueck.ch and posts on social media channels, contain information about items. Price and assortment changes as well as technical changes are reserved. All information (item descriptions, illustrations, films, dimensions, weights, technical specifications and other details) are non-binding and do not represent a guarantee of characteristics or warranties, unless explicitly stated otherwise. SwissCookware by Zöllner endeavors to provide all information and details correctly, completely, currently, and clearly, however, SwissCookware by Zöllner cannot guarantee this, either expressly or tacitly.
SwissCookware by Zöllner cannot give any guarantee that offered items are available at the time of order. Therefore, all information regarding availability and delivery times is without guarantee and can change at any time and without notice.
3. Prices
Subject to deviating offers, all prices are understood to be gross in Swiss Francs (CHF). SwissCookware by Zöllner is not subject to value-added tax.
Shipping costs, unless otherwise provided, are charged additionally and are to be paid by the customer. Shipping costs are displayed separately during the ordering process. For order values of CHF 100 or more, SwissCookware by Zöllner covers the shipping costs.
Technical changes, errors, and misprints are reserved; in particular, SwissCookware by Zöllner can make price changes at any time and without prior notice before contract conclusion.
4. Contract Conclusion
The offers and quotations from SwissCookware by Zöllner represent an invitation to the customer to order items. The offers and quotations are not binding for SwissCookware by Zöllner. Offers, dates, and deadlines communicated by SwissCookware by Zöllner before contract conclusion are subject to change and non-binding.
The contract is concluded with the order confirmation by SwissCookware by Zöllner and with the completed full payment by the customer.
If it becomes apparent after conclusion of the contract that the ordered item cannot be delivered, SwissCookware by Zöllner is entitled to withdraw from the entire contract or from a part of the contract. If the customer's payment has already been received by SwissCookware by Zöllner in whole or in part, the payment will be refunded to the customer accordingly. If no payment has been made yet, the customer will be released from the payment obligation accordingly.
SwissCookware by Zöllner is not obliged to provide a replacement delivery or substitute performance, nor is it obliged to pay compensation for damages in the event of a partial or complete dissolution of the contract.
5. Right of Withdrawal
The customer has the right to withdraw from the contract with SwissCookware by Zöllner within 14 days after receipt of the goods (in the case of partial deliveries, after the last goods). The withdrawal does not require any justification. To exercise the right of withdrawal, it is sufficient for the customer to return the relevant items unused and in original packaging within 14 days of receipt. The return shipping costs are borne by the customer.
Any payment already made will be refunded to the customer. For this refund, SwissCookware by Zöllner will use the same means of payment that the customer used for his payment.
Excluded from the right of withdrawal are special orders as well as personalized, used, or damaged items.
SwissCookware by Zöllner reserves the right to demand appropriate compensation for damage, excessive wear and tear, or loss of value due to improper handling and to deduct the reduction in value from the already paid purchase price or to invoice the customer for it.
6. Payment Terms
The payment methods indicated in the ordering process are available to the customer in the online shop.
By choosing an online payment method, the customer authorizes SwissCookware by Zöllner to collect the payment via the corresponding means.
When paying by invoice, the customer is obliged to pay the amounts invoiced by SwissCookware by Zöllner within the period specified on the respective invoice or, if such a period is missing, within 30 days of the invoice date.
If the invoice is not settled within the aforementioned payment period, the customer is automatically in default and owes default interest at the statutory rate of 5% as well as further default damages (collection costs, etc.). A reminder fee of CHF 25.-- is charged to the customer for each written reminder (by email or post).
SwissCookware by Zöllner reserves the right to demand advance payment at any time without stating reasons.
In the event of non-payment within the period, SwissCookware by Zöllner is entitled to refuse any further performance and/or to withdraw from the contract.
Offsetting the invoiced amount with any possible claim of the customer against SwissCookware by Zöllner is not permitted.
7. Delivery, Inspection Obligation, Notice of Defects and Return
Deliveries are shipped to the address specified by the customer in the order. No deliveries are made abroad or to P.O. boxes. The delivery period is usually two working days. In case of delivery delays, the customer will be informed promptly. Delivery delays neither justify claims for damages nor withdrawal from the contract.
Upon notification of readiness for shipment, but at the latest upon shipment, benefit and risk pass to the customer.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, SwissCookware by Zöllner can cancel the contract after a notice of complaint by email to the customer and by setting a reasonable deadline, and invoice the customer for the costs of the efforts.
The customer is obliged to inspect the delivered items immediately upon receipt of the delivery and to report any defects for which SwissCookware by Zöllner provides warranty in writing by email to SwissCookware by Zöllner within five calendar days, otherwise the delivery is deemed approved.
Returns to SwissCookware by Zöllner are at the customer's expense and risk. The customer must return the items in their original packaging, complete with all accessories and together with the delivery note and a description of the defects to SwissCookware by Zöllner.
If the inspection by SwissCookware by Zöllner reveals that the items have no detectable defects or that these do not fall under the manufacturer's warranty, SwissCookware by Zöllner can invoice the customer for the efforts, the return shipment or any possible disposal.
8. Warranty
SwissCookware by Zöllner strives to deliver items in flawless quality. Deviations within the scope of industry-standard tolerances must be tolerated by the customer and do not justify warranty claims. SwissCookware by Zöllner does not assume any warranty for damages due to careless handling, ordinary wear and tear, non-compliance with applicable standards, unsuitable or improper use or care, or due to excessive weather influences and other excessive physical impacts. Consumables and wear parts (e.g., batteries, accumulators, etc.) do not constitute a warranty.
For defects reported in a timely manner, SwissCookware by Zöllner assumes warranty for freedom from defects and functionality of the item purchased by the customer during the warranty period of two years from the delivery date. It is at the discretion of SwissCookware by Zöllner to provide the warranty through free repair, equivalent replacement, or by refunding the purchase price. Further claims are excluded. If the manufacturer grants a longer guarantee period, this applies instead of the warranty.
Warranty cases neither permit a retention of payments nor a claim for damages.
9. Liability
SwissCookware by Zöllner excludes any liability, regardless of its legal basis, as well as claims for damages against SwissCookware by Zöllner and any possible auxiliary persons and vicarious agents. SwissCookware by Zöllner is in particular not liable for indirect damages and consequential damages due to defects, lost profits or other personal, material and pure financial damages of the customer or of third parties. Excluded is any further mandatory statutory liability, for example for gross negligence or unlawful intent.
SwissCookware by Zöllner uses hyperlinks on www.kuechenglueck.ch solely for the simplified access of the customer to other web offers. SwissCookware by Zöllner cannot know the content of these web offers in detail nor assume liability or other responsibility for the content of these websites.
It is not possible for SwissCookware by Zöllner to make assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and further contents. In particular, it is neither assured nor guaranteed that the use of the website does not infringe any rights of third parties not owned by SwissCookware by Zöllner.
10. Data Protection
The protection of the personal data of its customers is important to SwissCookware by Zöllner. SwissCookware by Zöllner takes the topic of data protection seriously and ensures corresponding security. SwissCookware by Zöllner processes and maintains personal data in accordance with the provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP) and, where applicable, other data protection regulations, in particular the General Data Protection Regulation of the European Union (GDPR).
The customer takes note and agrees that SwissCookware by Zöllner processes his personal data for the purpose of providing its services and also passes it on to third parties. The customer can object to this consent at any time in writing (email suffices).
The customer agrees that SwissCookware by Zöllner uses his data to carry out advertising measures (online or print), in particular to provide him with information about offers.
The customer has the possibility to object to these advertising purposes at any time, by notification to SwissCookware by Zöllner.
For the rest, reference is made to the data protection declaration of SwissCookware by Zöllner, viewable at www.kuechenglueck.ch.
11. Further Provisions
SwissCookware by Zöllner expressly reserves the right to change these GTC at any time and to put them into effect without notice, each time applicable to contracts concluded from that point onwards.
Should individual provisions of these GTC be void and/or ineffective in whole or in part, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The void and/or ineffective provisions shall be replaced by those which come economically closest to the purpose of the void and/or ineffective provisions in a legally effective manner. The same applies in the event of any regulatory gaps.
In the event of disputes, exclusively substantive Swiss law shall apply, to the exclusion of conflict of law rules. The UN Sales Law (CISG, Vienna Sales Law) is explicitly excluded.
The place of jurisdiction is St. Gallen, provided no mandatory jurisdiction for consumers exists.
These GTC are translated into different languages. Only the German version is legally binding.
